Here are some of my thoughts on what rights we as consumers should be guaranteed.
1) Truth in Advertising.
a) A consumer expects that if a service advertised at XXX speed, that service is a guaranteed speed across the service providers network up to Interconnecting Networks.
b) Services advertised shall not be limited unless clearly stated in the service agreement. Services advertised as 'unlimited' will not have transfer limits, Ex. if a customer has a service agreement stating speeds of 3Mb/sec, the user has the reasonable expectation of transferring 3Mb/sec every second of every day on the carriers network.
2) Monitoring, Filtering and Prioritization of Traffic
a) Monitoring of traffic shall take place upon the same standards as federal wiretap laws.
b) Service Filtering shall be optional to the consumer, except where traffic is deemed harmful to Network Equipment,other consumer equipment or by national decency law
c) Service Filtering Rules must be disclosed in a real-time published format in line with the consumers Service Filtering Selections.
d) Service Filtering Rules must be optional and have the ability to "Turn off" in real-time, except where lawfully imposed.
e) Service Filtering may be imposed to protect network services from malicious traffic.
f) Service Filtering shall not be imposed upon any one network service, protocol, or content type.
g) Prioritization may not interfere with a consumer’s right to network access as set out by contract with regard to service speed.
h) Prioritization rules must be disclosed in a real-time published format.
i) Prioritization rules must be optional and have the ability to "Turn off" in real-time, except where lawfully imposed. Ex VOIP 911 Service
